Public Hearing RE: New Zoning Ordinance 295, Sign Ord. 296, & Nuisance Ord. 297

 

Notice is hereby given that the Board of Supervisors of North Cornwall Township will hold a Public Hearing and receive questions and comments on proposed Ordinance No. 295, the proposed new North Cornwall Township Zoning Ordinance and the new proposed Official Zoning Map, on Tuesday, April 18, 2017 at 7:00 p.m. at the North Cornwall Township Municipal Building, 320 South 18th Street, Lebanon, Pennsylvania. Proposed Ordinance No. 295 will completely repeal and replace Ordinance No. 266, the North Cornwall Township Zoning Ordinance of 2011 (as amended by Ordinance No. 270 of 2012 and Ordinance No. 281 of 2014), and the proposed Official Zoning Map will replace the current Zoning Map.  A summary of the proposed ordinance is as follows:

 

The proposed new Zoning Ordinance primarily regulates the uses of land and structures, with differing standards in differing zoning districts as shown on the proposed new Official Zoning Map.  The proposed Ordinance addresses the following major subject areas:

 

Background Provisions and Definitions, including the Purposes, Scope, Establishment of Zones, and Zoning Map;

 

Zoning Districts, including the Purposes and Uses in each District, Limitations on Subdivision and/or Land Development, Area and Design Requirements, Lot Area/Width/Coverage Requirements, Minimum Setback Requirements, and Outdoor Storage and Display Requirements, as may be applicable to each District;

 

General Provisions and Accessory Uses, including Access Drive and Driveway Requirements, Clear Sight Triangle Requirements, Access to Properties and Structures Requirements, Establishment of More than One Principal Use on a Lot, Front Yard and Height Limit Exceptions, Outdoor Lighting provisions, Off-Street Parking, Loading, and Loading Space Requirements, Landscaping and Screening Requirements, Required Parking Spaces, Parking of Recreational/Commercial/Unlicensed/Uninspected Vehicles, Operations and Performance Standards, and Requirements for On-Lot Sewage Disposal Systems;

 

Conditional Uses and Special Exceptions, including Procedures for Filing and Hearings, Waiver Request Processes, Time Limitations, and Specific Use Standards;

 

Sensitive Natural Resources, including Feature Identification, Review Procedures, Delineation of Districts, Flood Damage Control Regulations, Additional Safeguards, Factors for Consideration when Reviewing Variances, Nonconformities, Designation and Duties of Floodplain Administrator, Building Permits, Application Procedures and Requirements, Administrative Requirements, Enforcement, Wetland Delineation, Steep Slope Delineation, Forestry Uses and Timber Harvesting Requirements;

 

Nonconformities, including Continuation, Abandonment, Extension, Expansion, or Alteration of a Nonconforming Use, Substitution or Replacement, Restoration, Unsafe or Unlawful Structures, Removal of Junk, and Use;

 

Zoning Hearing Board, including Establishment, Membership, and Organization thereof, Public Hearings, Time Limitations for Decisions, Functions, Substantive Challenges to the Validity of the Zoning Ordinance, Special Exceptions and Variances, Appeals, and Mediation; and

 

Administration, including Duties and Responsibilities of the Zoning Officer, Violations, Enforcement Notices and Remedies, Requirements and Applications for Zoning Permits, Zoning Certificate of use and Occupancy, Fees, Zoning Amendments, Conditional Uses, Mediation, Information Submission Requirements, Severability, and Repealer.

The Board of Supervisors of North Cornwall Township will vote upon the Ordinance after receiving questions and comments. Notice is hereby given that the Board of Supervisors of North Cornwall Township will receive questions and comments on proposed Ordinance No. 296, which establishes a Sign Ordinance and repeals Ordinance 266, Section 322 in its entirety; and Ordinance No. 297, which establishes a Nuisance Ordinance and repeals Ordinance 266, section 314 and Ordinances 87, 196, 197, 198, and 199 in their entirety, at its public meeting on April 18, 2017 at 6:00 p.m. at the North Cornwall Township Municipal Building, 320 South 18th Street, Lebanon, Pennsylvania.  A summary of the ordinances is as follows:

 

Ordinance No. 296 - Stating the purpose of the Ordinance; Defining permanent and temporary signs; Defining permanent business signage, residential signage, general signage, and public use, government, or utility signage; Establishing design and construction types of permanent and temporary signs; Identifying types of temporary signs; Regulating sign area and height; Providing for general regulations of signs, including maintenance and inspection of signs and removal of signs; Restricting certain types of signs and signs in certain locations; Addressing lighting and illumination of signs; Limiting dynamic message signs to certain zones; Setting forth permitting procedures and fees; Providing for nonconforming signs; and establishing procedures and penalties for violations.

Ordinance No. 297 - Stating the purpose of the Ordinance; Providing definitions; Declaring nuisances illegal; Identifying nuisances, including the following: accumulation, storing, dumping, and odors; certain animals and animal activity; building and property maintenance nuisances; burning, blasting, fires, and fireworks; business solicitation and private garage/yard sales; noise; certain personal conduct; sanitary sewer and storm water drainage; street obstructions and other street-related nuisances; vehicles and equipment; and vegetation; Providing for notice to violators, enforcement, and penalties for violation; Addressing offenders and complaints; and establishing remedies.
